5. Limitations:

Human oversight has baked-in weaknesses. Cognitive limits, automation bias, and time pressure mean humans often don’t catch mistakes—and may even make good outputs worse. The chapter warns not to treat oversight as a safety net that justifies lowering other safeguards.

Too often, “human oversight” is used like a magic word—throw it in a contract or compliance plan, and you’re good. This chapter cuts through that illusion. Fink shows that human oversight only works if it’s well-designed, resourced, and goal-aligned. Article 14 won’t fix risky AI use unless deployers and providers get real about its limits.

And there’s the deeper layer: Article 14 is becoming the benchmark for responsible AI across Europe, even outside public procurement. The way oversight is implemented—whether rubber-stamped or thoughtful—will shape how much trust the public puts in these systems.

  • Accountability modeling: While it touches on the “liability sponge” problem, it doesn’t offer alternative frameworks. How do we build accountability into system design without dumping it on the last human in the chain?
  • Sector-specific examples: The Petrov anecdote and grocery store flagging are useful, but a deeper look into real-life use cases (e.g. predictive policing, education algorithms) would help connect theory to practice.
  • Operational checklists or templates: Practitioners reading this may leave with more clarity, but not necessarily with implementation tools. A sample checklist or role matrix would be a practical next step.
